By using sculptherbyjosie.com, submitting one of our forms, booking a call, joining a challenge or buying coaching, you agree to these Terms. Please also read our Privacy Policy.

1. Our services

SculptHer By Josie provides online 1-on-1 fitness and nutrition coaching for women, free strategy calls, free fitness challenges, and related guides and content. Coaching is delivered online, including through the Everfit app.

2. SMS / Text Message Terms

Program name: SculptHer By Josie Coaching Texts

What you will get: if you tick a text-message box on one of our forms, SculptHer By Josie will text the number you gave us.

• Non-marketing texts (if you tick that box): replies to your coaching application, strategy-call confirmations and reminders, replies to missed calls, new-client onboarding steps, weekly check-in reminders and program-ending reminders.
• Marketing texts (only if you tick the separate marketing box): coaching offers, free challenge invitations and new program updates.

Consent is optional. You never have to agree to texts to submit a form or buy coaching.

How often: message frequency varies.

Cost: message and data rates may apply for any messages sent to you from us and to us from you. Ask your mobile carrier about your plan.

To stop: you can cancel the SMS service at any time. Just text STOP to (725) 425-1105. We will send one message confirming that you have been unsubscribed. After that, you will not get any more texts from us. STOP, STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT all work.

Carriers: carriers are not liable for delayed or undelivered messages.

3. Health and fitness disclaimer

• We are fitness and nutrition coaches, not doctors, dietitians or medical providers. Our coaching is not medical advice and does not diagnose or treat any condition.
• Talk to your doctor before starting any exercise or nutrition program, especially if you are pregnant, injured or have a medical condition.
• You take part at your own risk and agree to tell us about any injury or condition that could affect your training. Clients also sign our Health History & Waiver form.
• Results vary from person to person and depend on your effort, consistency, health and other factors. Testimonials and before/after photos show individual results and are not a promise of the same results.

4. Coaching purchases, payments and refunds

• Prices and what is included are shown at checkout or in your coaching agreement.
• Payments are processed securely by our payment provider.
• Refunds and cancellations: all sales are final. No refunds are given on or after your coaching agreement date. If a client cancels for any reason, the client is not entitled to a refund.
• If you have signed a separate coaching agreement, that agreement controls where it differs from these Terms.

5. Calls and appointments

Please reschedule or cancel a booked call ahead of time using the link in your confirmation.

6. Our content

All programs, guides, videos, plans and other content we provide belong to SculptHer By Josie. They are for your personal use only. You may not copy, resell or share them without our written permission.

7. Your responsibilities

Give us accurate information, keep your login details private, and use our services lawfully and respectfully.

8. Limitation of liability

To the fullest extent the law allows, SculptHer By Josie is not liable for indirect, incidental or consequential damages, or for any injury that results from following a program without proper medical clearance. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

9. Changes

We may update these Terms. The "Last updated" date shows when they last changed. If you keep using our services after a change, that means you accept the new Terms.

10. Governing law

These Terms are governed by the laws of the State of Nevada.
